Parking Eye - Letter Before Action

Hi

Like other posters I have received a number of letters from Parking eye regarding an alleged infringement earlier this year.

Am I right in thinking that the current advice is to respond firmly to both PE and to the MSA that employs them rebutting their claim?

Assistance and advice would be appreciated

    Yep, respond to PE and rebut, and respond to the MSA and assertively complain and ask them to act to quash the 'ticket'. Read these threads:

    Template letter sent to PE on Saturday. Response received today. They refer me to various costs they have incurred as an example of why their charges are not disproportionate and say they are prepared to pursue through the courts. Plus a load of "we've seen this before and this is our standard response" stuff.

    I guess I have to go through the links you kindly provided to check out my next steps but they're looking pretty determined from where I stand

    Ah yes, the PE template response complaining about receiving a template. Irony.

    Most important thing to do if you choose to defend this is to log a defense on-line with the Court which buys you time to collate a proper response.

    PE will continue to bully you into paying up buy quoting QC opinion, etc, which is exactly that, an opinion and not case law.

    They do not want to go to Court, remember that as win or loss, they loss money.

    A correctly constructed defense will see you on the balance of probability win in Court.

    PS no POPLA number provided which would appear to have been the main intention. I guess they're getting wise to that one

    So are you at the soft appeal stage to the PPC or have received a Letter Before Action?

    I had an LBA last week and responded with a letter asking for more details. This is their response to that.

    Reading other threads it would seem that I can respond with (yet another) letter or log a defence online.

    Personally I'd prefer to keep things out of court but would take the advice of others who've been here before

    This quote "Appealing at this stage would have also given you the chance to appeal your charge at POPLA (the Parking on Private Land Appeals Service) had your appeal to Parking Eye been unsuccessful" would seem to be saying that I have missed the opportunity for getting a POPLA number and - from a number of threads I have read - that would appear to be misleading at the very least

    Up to you, they will continue to bully and attempt to dupe you into paying up. Yes, going to Court can be a lottery if you get a Muppet of a Judge, but if you want to pay them and line their pockets feel free. With research and a well constructed defense statement, they will probably not pursue you through Court. You have received their standard LBA response template, which works, as quite a few people pay up at this point.

    Read the contents of my post that is linked to my signature and you will see that a similar response to PE will see their claim is unenforceable.

    Could cover all my bases with both a letter AND a court application :)
