CDA Warranty and my rights

Dear All,
Recently my washing machine died (CDA) after four years of use but I remembered when I made the purchase that if I registered it via the warranty card I would get 5 year parts warranty as long as I paid for the labour, great I thought.
I got in touch with CDA who required proof of purchase which I supplied and they confirmed my 5 year parts warranty. They then told me due to the nature of the fault they cannot repair it but would provide a new appliance at a discounted price, great I thought.
They have since come back and said the new appliance will cost me £535.42, that is with my discount?? I checked online and I can purchase the model suggested for less than £500!!
I just want my old machine repaired at a cost of call of a £89 call out fee which I belive is fair as it is still under warranty, not an offer that is higher than I would have to pay online. Does the warranty mean nothing??
Please advise me of my rights and what I can do about this.

It will depend on the terms of the warranty. There is no statutory requirement for goods to have a warranty. They do have to follow the terms they agreed with you though. What do the terms say?
Your statutory rights are with the retailer you bought it from. If the fault is an inherent one (not due to misuse or wear and tear) then they have to offer a refund (which can be partial), repair or replacement. After 4 years it will be up to you to prove it is inherently faulty, and if it can't be repaired then the best you will likely get after 4 years is a partial refund if it is deemed that it should have lasted more than 4 years. If 4 years is deemed acceptable then you won't get anything0 -
They have admitted I am covered by warranty but just cannot fix the problem, I dont know if thats due to no replacement parts or not an economical repair. This is why they are offering a replacement washing machine. The problem being that they will provide this machine at a greater cost than I can buy anywhere else.
Is this is fair?0 -
Just out of interest - what do they say is wrong with it and have they said why they will not repair it (parts not available/not cost effective)0

well like most white goods in that they constantly change and after a certain period parts for old machine are no longer manufactured or stocked. as they just dont have the resources to stock these parts. a lot of companies would offer refurb. machines at a reduced cost. But in your case they are offering a machine higher that you can get on the high street, which is not uncommon either. when my printer went under warranty Epson could only offer a refurb, but when i checked i could get a new one for less. Told Epson this but the could not match it, but agreed to add an extra 6 months warranty onto new printer if i purchase it and let them know.0

Those washing 5 year parts warranties are just a con in my opinion,
I once had a machine that broke down after about two years, to get it fixed I had to pay the standard call out/labour charge. I found out at the time that if the machine was older than 5 years the price would have been the same.0
