Smart parking fine - slightly different this one!

Some ASDAs have signs like this

'disabled blue badge holder? register your vehicle at the customer service desk to receive your exemption from this time limit. need longre? just ask.
Why not phone the store and retrospectively register your vehicle at the customer service desk. If they won't do it, phone the manager and ask why his/her store is not clued up like the one in the sign. Get it in writing that you have an exemption then appeal to smart parking.
They try this particular trick when it's a general colleague that deals with them.
They're not quite so belligerent if they come across a some what forthright manager.0 -

THis is slightly different as I think I am bang to rights, however I received a Parking Charge Notice from Smart Parking Ltd, (also trading as Town and City Parking) after parking in an ASDA car park.
We have use of a disabled badge for my young daughter, this was on display and parked in a disabled bay. However we were over the limit of three hours, by 20 minutes.
I have no problem paying the £40 due to this and I am not trying to wriggle out of anything. What I do not want to do is to pay a fine to someone who is not legally entitled to impose that fine on me
As I have read countless times on this forum the best idea is to simply bin it but my wife was a bit worried. Googling this company throws all sorts of threads from MSE and Peppipo etc saying exactly the same thing, but due to the fact we were over three hours this is different.
So are is this company still entitled to set this arbitrary limit and then invoice people who stray over it. If I am bang to rights then I will pay.
Many thanks!
Jake
You are not bang to rights you have just had a request for money from a company that have no legal right to enter into any contract with a motorist as they do not own the land...See my thread on CAG (consumer action group) entitled TCP/ Roxburghe send cheque and apologise....:beer:0 -
Many thanks all, I sent a copy of the badge with the appeal slip. Of course this will be rejected, at this point I will escalate as mentioned above.

Make sure you come back for advice on any POPLA appeal, don't go it alone. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Can I use the basic premise of that letter you have linked to and send onto Asda? Obviously changing the details required?
Certainly you can, and do so now (do not wait for the rejection of your appeal).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

UPDATE:
Letter received yesterday stating that the parking charge notice had been dropped.
This is after I sent a photocopy of the disabled badge.
I wasn't expecting such a swift resolution to be honest.
Many thanks to all that has provided assistance in this matter.

And so it bloody should have! I would have also been onto the local paper to prove how wrong Asda and their parking agents are. For every one of you, there are loads that buckle and pay up making this the lucrative business that it is.
Well done to those on here who made this positive result happen.Search my post " PoPLA evidence - What to submit" on what is a good defense for a PoPLA appeal.0 -
Hello, I have recently gotten the same letter from the same Asda store, I emailed head office and they emailed back to say that they would revoke the PCN, I was also on holiday and went over the time by 17 minutes, to be honest I didn't think of ignoring it till I came on here and by that time I had already emailed them, Hope this helps!
Well done Ruby, glad you had it sorted.
