Hi all,
Myself and my wife are a normal couple.
I am working 20 hours a week and are claiming child tax credits and my wife is studying part time 3 days a week.
We understand that she cannot claim job seekers allowance if this is the case. Is this true.
I also understand that if we are not claiming job seekers that i will get working tax credit. And just to throw a spanner in the works she is also disabled so not sure whether certain rules apply to her.
So confused with all the rules and need some clarification as it seems people who work and study to better their prospects seem to be penalized as it would mean bringing in less than when we were both unemployed.

Your earnings over £112 a week rule out JSA unless she is entitled to contribution based.
At 3 days the course is likely FT, so no JSA as not available for work.
Are you both looking for work and are you claiming other benefits?0 -
We claim DLA, CTC and CB and have 2 kids.
Just confusing as she is available for work on a monday and tuesday yet we believe not eligible for JSA.0 -
To claim JSA you need to be available for full time work not just Monday and Tuesday0

Depending on her disability yes, WTC is paid at 16 hours to those whose partner is classed as incapacitated.
I'm on my phone overseas with a poor wifi signal but google WTC and incapacitated for more information and see if you are eligible. I know DLA is on the list but can't remember if it has to be MRC or higher.0 -
