  • I''d like the OP to return and clarify the situation. If she's a home-owner and this non-paying wretch is a lodger he can be got rid of quite easily.

    If it's rented property and the wretch has no tenancy agreement with the landlord he is still a lodger and can also be got rid of quite easily.

    I'd have given him notice the day after the rent was due and remained unpaid regardless of his empty threats about locks and exclusive occupation.

    I suspect he's just a fantasist bully about being a solicitor and dearly hope that the rent he hasn't paid is going towards his imminent onward move. I met someone like this and they were very persuasive because they had long experience of taking advantage of other, much less cynical people.

    OP, I'm a 'sturdy girl' as a "friend" once described me, and I live in London. I never throw a punch when a chair will do.

    If you'd like some company (I can give you character references - "looks like a bruiser but would only kill and eat you if she were REALLY hungry and u got on her bad side...") to deal with Mr *nobend, I would honestly, happily help. Hate bullies.

I googled HMO and u new 3 tenants to form HMO. https://www.gov.uk/private-renting/houses-in-multiple-occupation I replied one of his emails to yday and asked again that he leaves peacefully and willingly. I was at the CAB and rang shelter as well. They both think he's an excluded tenant but worry if he claim he has exclusive access to his bedroom though he doesn't. I have a key and enter about twice a month. I lock my bedroom and of course he doesn't have a key. I appears I will have to change the lock to the flat.

    Change the locks while he is out, ignore the fact that he's a solicitor, any solicitor with 15yrs experience that is lodging in someone else's property clearly doesn't have a clue ;)
  • So, this is a rented flat then? Does this person have a signed tenancy agreement with the landlord? If not, and you haven't given him a tenancy agreement yourself then he's your lodger. Give him 24 hours to pack and leave, and then change the locks
  • ...and do NOT tell him that you are about to change the locks. Just do it.

    Not sure of the legalities, but it is your home so think you should be OK. Could you not have your mobile on record next time he starts being nasty?

    Ofcourse you can record in your own home.

    The ONLY place where you cannot record is if you are stood or positioned (ie in a vehicle) on someone else's private property, where they do not allow video recording.

    ANYWHERE else is fine to record

    Simple, change the locks, if he complains just say i told you 2 days ago to get out and gave you 24 hours notice.

    That's it, have his things ready to be collected, with the police present and then wave bye bye to this waster
  • Hi all, thanks again for reading and replying my post. I just wanted to up date you. On Wednesday I changed the locks. Apparently it very easy to do. I did it myself in a bid to cut costs. I left a note on the door and sent him an email to pls make arrangements to pick his things. I went out soon after and he'd taken the note by the time I returned. The next day I emailed him again re his things and he later replied no abuse or threats in him emails. He came later that evening and overly polite and humble, he took his things no problems. I had a friend with me an she knew he was pretending and exaggerating his humbleness. She thinks he still intends to so. Me, I'm just glad he's gone!

    Well done for bringing this to a peaceful and satisfactory conclusion. I have in past shared a house with someone who was abusive to me and I know how soul destroying and awful it is.
    It is a good idea to be alone in a garden at dawn or dark so that all its shy presences may haunt you and possess you in a reverie of suspended thought.
