I am currently on maternity leave I work for a large company and we all got an email yesterday asking us to attend head office. As I am not working at the moment I did not attend I then found out through friends that the company has gone into administration and everyone has lost there jobs apart from some sales people who have been taken on from the new company which we do not know about.
What are my rights they said they are not paying us I started my maternity leave two weeks ago so I am due last months wages.
I have been told by the rest I need to hand my car back.
What do I do know am I entitled to redundancy pay I have been there 6 years. How about my wages , commission and holiday pay?.
Any advice would be a great help.
Thank you

I'm in the exact same situation!! Started mat leave 1st August... Only difference is I wasn't told of the meeting as handed in laptop and phone when mat leave started. Can you inbox me any advise please? I'm waiting to speak to hr as I'm shocked no one has told me anything. I've looked and there are some section on the human rights policy which relates to redundancy whilst pregnant. Cheers xx0

Hate to be the bearer of bad news, but.....
If a company goes into administration it is because they have no money to pay for anything, so there is a strong possibility that the company would cease to exist (and be liquidated).
If you are pregnant, you have the same rights as someone who isn't. The only thing they can't do if you are pregnant is to discriminate - ie: sack you as you are pregnant. If the company is in administration then they usually lay off some (if not almost all) employees.
Basically the company need to pay you for your owed: pay, notice, redundancy etc, but it is doubtful you will get any of this, as the company has no money. If you do, then it will only be though the administrator, which will take a while (months). Basically they add up all the companies assets (what they own) sell them for what they can get and split up the proceeds amongst who they owe money to. As an employee, you take preference over trade creditors (suppliers), but this pay out would only happen when the company or assets are sold (which will take months).
If the company can't pay anything, the government can pay the legal minimum that you are owed - check out https://www.gov.uk/your-rights-if-your-employer-is-insolvent/claiming-money-owed-to-you
Basically, you can claim:
redundancy
wages - up to 8 weeks’ worth
holiday pay - up to 6 weeks’ worth
statutory notice pay - 1 week after 1 month’s service, going up to 1 week per year of service (up to a maximum of 12 weeks)
unpaid pension contributions (your pensions administrator does this for you)
basic award for unfair dismissal
also for you:
Statutory Maternity Pay
I would find out from the company what they can pay you (if anything) and when, then follow the instructions on the link above for what the government can do.0 -

Looks like it.
If you're one of the unlucky 170 who have lost out despite the pre-pack then the administrators - Ian Corfield and David Dunckley of Grant Thornton - would be the people to speak to.0
