Tax Credits Claim

Hi I am hoping someone here can help.

I had my claim for tax credits cancelled a year ago as they said that my ex partners post still coming to my address was proof that I was not single. As we are both on the mortgage my ex insists that it is his right to have his post sent here and as his new partner is on benefits he does not want to be associated at her address I guess for the same reason that happened to me.

Anyway out of sheer fear I accepted the tax credits decision and arranged a repayment arrangement.

My ex has now moved the majority of his post out of my address. His bank statements still come here but I have now started returning them to the bank through the post.

What I need help is, as he now refuses to pay his half of the mortgage I am responsible for the house and the 2 children on part time wage so could really do with the benefits back that I am entitled to.

Can I make a new claim now baring in mind that I am currently paying back a debt? I cannot find any information on the tax credits website about making a claim whilst paying back a debt. I currently receive nothing but my part time wages and child benefit.

    you can make a new claim but you will still have the same problems if you cannot establish that your ex lives elsewhere.
    do you get the 25% council tax discount?
    is he on the elctoral roll still?

    if you are missing out on your entitlement because his new partner is claiming fraudulently, then why not just tell taz credits where he is living and let them sort it out?

    I think I have convinced him to change most of it over but the things that remain like bank and his inland revenue paye stuff and car insurance are the things that he wont change. I have already started sending it all back and I am hoping that this will do the trick. If I don't hand this stuff to him and return it all to sender, the only way for him to get it is to give them another address which is what I want him to do.

    Does anyone know that seeing as I already have a payment arrangement with Inland Revenue for this debt will they link this debt with my new claim and reduce my entitlement to clear come of the debt or will this be separate as I am already paying it off separately?
  • My ex is not on the electoral roll under my address and I do get council tax rebate for single person but this was the case when Tax Credits decided I was lying and said that this does not mean anything.

    How on earth did HMRC know about your ex's mail being delivered? I'm struggling to think of how they checked that (I used to work for them)

    The letter I had for a similar matter said 'we are working closely with a credit reference agency', so presumably they use a credit reference agency to check if people other than the claimant have bank accounts, credit cards, mobile phones etc etc registered at the relevant address. If the OP'd ex still has all his mail delivered to hers, it would look to a credit reference agency like he was still living there, for a guess.
