Santander PPI claim fail, help please.

Hi I hope someone will be able to give me some advice I recently started to claim back PPI from a loan my husband had with Abbey which was taken out in 2004 and only ran for a couple of years until he refinanced, the claim was due to being told the loan had better chance of approval if he took it out despite his reservations at the extra cost each month.
Just over a week ago he had a phone call from someone wanting to go over the details with hindsight he should have told them to write a letter and not taken the call but we didn't realise this until afterwards, he has now received a letter saying the claim has been refused because the policy would have paid out if he was sick or died.
I am unsure now as to whether to get back to them disagreeing with their decision or to go straight to the ombudsman, any help would be very much appreciated, thankyou.
