Housing Benefit Assessment

Over 3 months ago we were asked to send details of my husbands earnings to the housing benefit office.
Following this they wrongly assessed the claim as they thought the amounts were for 6 months not a full year. Which was ridiculous as they asked for the years wages.
We have done absolutely everything we can to put this right, sent bank statements, wage slips and co operated with everything they have asked for.
However the amount is still wrong and no matter how many times I ring I just cant get any answers. Even the staff I have spoken to including the manager admit they don't know what is going on.
Due to this we have fallen behind in rent payments, the letting agent has been understanding but now wants all the arrears in full or we will be given notice.
I just don't know what to do, can we take legal action against the benefit office.

I think what you really need to do is get a complaint made. The Manager saying they don't know is honest but doesn't help. In my situation, I would make an interim payment where possible.
I would also contact your local councillor and ask for them to assist you as this always works at my LA!I currently manage a Housing Benefit service and have been working in Housing / council tax benefit (as was) since 2001.
