B6.2 If you provide parking facilities to the general public for
a fee, your system must allow drivers who have not paid
the fee to leave a site within a reasonable period that
accommodates conditions and environments specific to
that parking site. This grace period should be sufficient
to enable motorists to leave without having their vehicle
registration mark processed for a parking charge.0 -
There will be nothing shown on the signs. Simply appeal on the point that you entered, drove round, discovered that you forgot your purse and left all within 12 minutes that you believe is covered by the paragraph you quoted.
Ask for the charge to be cancelled or a POPLA code to be issued. In the event of the latter, demand to know what their grace period is.0 -
thank you guys dad! thanks for your time' help an info0

after spending the day at cany beach an parking in the top carpark i headed off home .

i'm Asking you for the charge to be cancelled or a POPLA code to be issued. i am a single mum on benefits an feel that the fine is to much for just using your carpark as a safe place to stop an sort out my satvan
i would like to know your grace time at the carpark as B6.2 below

You haven't sent this I hope. The PPCs don't do mitigation. POPLA doesn't do mitigation either.
"Dear sirs,
Your reference xxxxxx dated dd/mm/yy
Vehicle reg xxxx xxxx
On dd/mm/yy, the driver entered your carpark (with children aged x & x )
After reading the signs to see the costs and getting them ready to come to come out of the car, the driver discovered that they had no change. They then put the children back in the car and drove off. This, according to your Notice to Keeper, took 12 minutes.
I believe that your association, the BPA, gives a certain period of grace for motorists to read the notice, decide if they want to park and then leave without incurring any charges. This section, headed Grace, reads
6.2 If you provide parking facilities to the general public forIt further says that you must be prepared to disclose your period of grace in force.

Under the circumstances and with me obviously getting no benefit from parking, I would be grateful if you would see your way to cancel the parking charge. If not, then please send me a POPLA code so that I can appeal to the independent adjudicator.
Yours faithfully.0 -
sadly yes i sent it oooop's0

Well, it may not be fatal, but did tend to dilute the grace conditions in the rest of that section of the BPA CoP.
Come back after you get the reply. You may be lucky and maybe they will appreciate your honesty. But if not, then we need to go to POPLA, unless you feel like paying up the reduced amount.0 -
thanks for your time i will be keeping my fingers an toes crossed..... if not i will be back for some more of your wisdom an knowledge i will keep you posted
thank you guys dad0
