Faulty car part... Refund request.

Hi,
06/06/13
I bought a critical component part for my car online that proved to have failed when fitted.
27/07/13
I contacted the retailer ( a national European car parts supplier) and requested a replacement part so I could swap and return the faulty part. They stated that they would only replace the faulty part if it was returned for inspection by the manufacturer.
The car could be driven with the faulty part in place however not with it removed, this meant that the car would be out of action until a decision had been made and a replacement sent.
I explained that this was not an option as the car is in daily use but they would not budge.
I have since had the part replaced by my local garage and have now sent the faulty unit back to the supplier however they are now asking for original receipts, and proof of my purchasing a replacement item prior to agreeing to a refund, they are also refusing to refund the full cost of return postage.
Can anyone advise me where I stand please?

A couple of things. Firstly, it's entirely reasonable for a retailer to be given the chance to have the "faulty" item inspected before providing a remedy, after all how do they know that you didn't cause the fault. Secondly, the seller is also entitled to see proof of purchase for the original item. They should, however refund all costs incl, cost of return postage.0

did you buy the part or did the fitting garage buy it?0

Ok thanks for your views so far, to answer the question... I bought the original (faulty) part, The garage only replace it with an OEM part after testing it and confirming it to have failed.0

In that case you have SoG rights and the retailer should pick up all costs assuming there is no evidence of incorrect fitting or abuse.
What's the part? who fitted it?0
