There have been many posts over the last 3 years about penalty charges issued by private companies operating car parks.
I received a similar penalty notice after parking in a Cornwall seaside car park two years ago. I did a lot of research.. the information can be found online.
The only powers able to issue PENALTY notices are the Police and Local Councils.
All that a private company can chase you for in a court of law are actual losses incurred. Example: you overstay up to 1 hour they lose 1 hours worth of normal parking charge, up to 2 hours overstay they lose 2 hours charges etc.
If you ignore an official looking Penalty Notice you will receive a further possible three letters warning of impending debt collectors and or prosecution. If after 3 notices you have not responded you will receive no further hassle.
Of course, should you choose to park every day and omit to pay then maybe you could become liable but only in a court of law.
Do research in these forums. the information is here.0 -

This is NOT the correct advice. Private "tickets" should no long be ignored generally. There are some very specific situations where it is safe to do so but the general advice is to appeal.0 -

Regrettably, your advice is totally wrong. If you need an example where a motorist has lost in court and has had to pay the charge, I can point you to one. It all depends upon the judge on the day and the relative competence of either the PPC counsel or the defendant.
Some PPCs indeed just send a few letters, involve a tame solicitor and debt collection agency and then give up, but others, such as Parking Eye are issuing court papers like they are going out of fashion.
That is why we advise appealing and then going through POPLA.
And may I refer you to your last sentence and respectfully suggest that you take your own advice.0 -

There have been many posts over the last 3 months as well and NONE of them tell people to ignore these fake PCNs any more. Where have you been?
The above advice is WRONG except in Scotland.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Oh well... I'll keep away then.
No need to keep away, just stick around, read some current threads and you'll soon understand why today's advice is quite different to the previous default 'ignore' advice.
It's much more interesting nowPlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Sorry - we didn't mean to bite.
We just want newbies not to misunderstand the current advice which is to challenge and win at POPLA (or just complain if it's a retailer and insist they cancel it).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

First of all, personally speaking - I dont like the word appeal as it makes these private charges sound official, what you are doing is disputing the charge, or challenging it.
Secondly the old ignore / loo roll bog paper / advice is a little out of date, but before sending a challenge to the parking company and insisting on a popla appeal, ( that is after they have written to your first - don't reply to a ticket on the vehicle) or even as you have sent the challenge to the parking company off
Complain to the land owner wherever possible It is they who have employed/accepted the parking company to act upon their behalf. The parking company are agents of the landowner, and therefore the landowner is responsible for its agents actions.
If the parking company becomes a pain and an issue to the landowner/car park owner instead of a solution ( to a non existent ) problem, then come contract renewal time it could be game over for the parking company.
And if i was a car park owner/land owner/ or responsible for a car park lumbered with a PPC contract here are a few solutions that could easily be achieved - the below should only be done on your property!! and all relevant H&S and other requirements should be undertaken ( risk assessments/working at height regulations etc) as well as any planning matters ( signage etc)
1: the bin bag+gaffer tape place bag over cameras, and fix with tape, no more harassed customers
2: Twist and point- most cameras are fixed on adjustable mounts and can easily be re-positioned without damage:
3: New signage/other items - a little more permanent than the previous two, but some well placed items will soon help things out a littleFrom the Plain Language Commission:
