Card Transaction Failed But Company Thinks I've Paid - What To Do?

    So that's where they stand 'legally'. On the other side of things, if the company doesn't notice then, sure, they'll get away with not paying - although there is the possibility down the line of it being picked up during audit.

    The whole 'if it's their fault' argument doesn't hold any water and, frankly, I find it hard to believe you when you say that if you'd sent two cheques you'd just chalk it up to experience. I personally would be onto the bank like a tramp on chips to have one of the cheques stopped/reversed.

    Anyway, it's your friend's call, nobody on here can tell you (or him) anything that you don't already know. I expect he's already made up his mind though and this question was asked in the hope of someone providing a reason for not paying.
  • Cheers for the replies - they know the money is owed and like I've said 99% sure they'll contact the company and pay up.

    I posted here more to try and settle a pub debate as to the legal position which has been answered so thanks for that :-)

    Can also say for certain that is not me - I'm afraid having a bedroom decorated in various shade of pink really doesn't float my boat lol
  • If you pay cash at a supermarket, and the cashier loses that money, are you responsible? No.

    So if you pay with a credit card, and the company do not process that transaction correctly, how are you responsible, and why should the customer be responsible for checking the payment has gone through, and then inform the company?

    If anything the company should notice then non payment , and then contact the customer requiring them to pay and apologising. If they don't, its their fault. You have not paid, correct, however you had processed the payment to your knowledge, the company is at fault due to their faulty equipment, so has the duty to complete the transaction

    Not even close to a relevant comparison.

    When you pay cash, the money has been paid, and you are no longer liable for the cash as it is not your property anymore. When you pay by card and it doesn't work, you have not paid and are legally obliged to pay as you agreed. A world of difference.

    It is senseless to hark on about who's fault it is - the fact is that payment is due and will remain due until paid.

    I would settle with the company to avoid a situation where the company realise the payment failed, and attempt it again when you have no money in the account. That's a story that's come up on these forums as well - and no one will refund or pay for your overdraft fees if this happens.
