For deprivation of capital to exist the person has to:
a) own the money (she doesn'), and
b) spend it with the intent of increasing entitlement to benefits (it wouldn't it would actually reduce entitlement as no SMI payable.
Neither apply in this case so dep of cap does not exist.0 -
Hi, benefitbaby is right. I was in a situation when I had to sell my house to move to a bungalow for my wellbeing and move near family for help. The bungalow was a little dearer than the money received from sale of the house and the mortgage could not be topped up enough to enable buying the much needed bungalow.
My parents told me that they wanted to pay the difference in order to enable me to move. The solicitor drafted a letter to my parents(stating they were paying the difference on the mortgage) for them to sign. The letter stated that they would pay a sum directly to the mortgage people and I received a copy of the letter/documents to send to housing benefit people. It was quite simple and I had no problems.
You should get a solicitor to draft such a document so that you can produce to the housing benefit department.0
