Speeding points

So I was caught speeding down a local road (52 in 30mph) and I was given a NIP and told to wait to hear from the police in due course....

I asked the officer at the time who said I would be likely to get a conditional offer of £60 and 3 points.

Anyone know how likely this is as the internet seems to indicate otherwise.

    I'd tend to agree, 3 points £60 fine. I very much doubt you'll be offered an awareness course at that speed, although I could be wrong.

    So what's you excuse for that sort of speed in a 30!

    Probably the same as the person that gets done for doing 35 in a 30.

    Looking into it further OP, it seems you could get a court summons for that sort of speed, and IF you do then you could be facing 6 points or possible short ban and fine.

    He could but that is not our worry really, he may already have 9 points, on the news recently a guy NEVER got banned for doing 76 in a 40.
    But at least the OP is not trying to worm his way out of it.

    50 is the normal cutoff point for a CoFP, so a summons is more likely.
  • My old dad got stopped for a little over 50 in a 30 years ago (52 or 54)and got 4 points and a £150 fine.
    THINK he had to go to court but not 100%.

    As another poster indicated, the Magistrates' Courts Sentencing Guidelines indicate, for speeding, that the starting point for an offender doing 52 in a 30 zone, without previous and without a guilty plea, is a Band B fine and disqualify 7 -56 days or endorse 6 points.

    There is a reduction for a guilty plea, but I don't know if that relates just to the financial penalty (don't forget the victim's surcharge will be automatically added, plus costs) or the points too.

    Most forces only offer fixed penalties at up to 49 in a 30 though I believe some offer them at up to 55 so cross your fingers and hope.

    If it goes to court the discount for a guilty plea applies to the fine but not to the points/ban, unless you're in Scotland in which case the Magistrates guidelines don't apply either and sentences can be much harder to predict.

    A Band B fine means approximately your weekly post tax income.

    Since this was in a 30 zone, i presume you weren't pulled over by a traffic unit, rather a local patrol.

    So what did you actually say to the officers? I presume you admitted the offence immediately and they rubbed their hands with glea.

    Perhaps we can help with a defence, but need to know what was said.

    For future reference never admit what speed you were doing.

    We all have the right not to answer questions, but verbal admissions rarely (if ever) form part of the evidence in speeding cases this is pretty much irrelevant in a case like this.
