Where do I stand in return, Ebay?

Bought a Brand New In Box Delinghi DEM10 Dehumidifier from Ebay - item arrived as described.

The seller is an individual.

The item is damaged, I sent the following to return item:

Hi, I tried the item this morning first time, and it makes a loud noise, and doesn't intake water after running for 2 hours. I searched for the problem: http://www.fixya.com/support/r4662409-dehumidifier_running_but_no_water_in
The one on the list which matches is (The compressor has failed…if you hear a buzz for a few seconds, every few minutes, then you have a bad compressor or at least bad start components on the compressor. Either way it again is a costly repair.)

I would like to return this item.

They rejected the return, saying:

Item was delivered brand new in box. There is a manufacturers guarantee with the item if it is faulty they will repair it for you."

This is true, but I don't see why I should be chasing up these problems, also it clearly states on the listing about returns:

After receiving the item, cancel the purchase within 14 days.

Buyer pays return postage.

Returns accepted.

You can open a returns/SNAD claim on ebay and will win the dispute, but you will need to return item fully tracked before paypal will release your refund.

As said open a SNAD and PayPal will refund you, you'll have to post back.

HOWEVER he is a business. So under SOGA he should be paying return postage and the responsibility is with him. Technically you could take him to small claims tog do your postage back.

Looking at completed the one I saw which matched ops description said business seller. I Probably saw the wrong one.
