DLA making me sweat!!!

My daughter was originally awarded HRC and LRM, on renewal it went down to MRC, i asked for a reconsideration, and it wasnt changed, i then asked to go to appeal, this was back in January.
Since then i had sent in extra info, letters from our consultant, GP, teachers and teaching assistants, photos, medical charts, and the kitchen sink, they still said no......i resigned myself to going to the appeal and was having major panics about what else i could possibly tell them that i hadnt already..........
we got our court date for next week, i rang the tribunal service to confirm the time and date only to be told the DWP had cancelled the appeal?????
I rang the DWP and yes, they had cancelled at the last minute reinstated my original award and extended it too!
Why couldnt they of just done that when i sent in the info, it'd of saved me a few sleepless nights!
Reading up on this it seems to be a common thing for them to do, wait right til the end then reconsider.........seems daft to me, but i am a happy mummy now and i dont have to worry about filling that poxy form in again for a good few years :)
Skint, but happy (ish):p

    - because only at the point where it was to go to an independent decision
    - did someone [with authority] in the DWP review at the claim
    - and decide that they - the DWP would lose

This is a classic case of why people should appeal / appeal / appeal.

I think I am going to be in the OP's position, if the amount that has appeared in my bank is correct (no letter as yet). * sigh* I will be back for advice...

Absolutely agree with this. As many regulars know, I undertook the task of helping a friend for many months when her LRM and HRC was cut to - zilch. :( She ended up having two ATOS visits, and after numerous letters, phone calls, and a date given for her tribunal, she was not only given the DLA back, but it was increased to HRC and HRM. :j

I think many people are going to find it necessary to appeal over and over again, and those that have the tenacity to keep going, will be OK, but it's time consuming, frustrating and distressing.

I have gone through two tribunals in the past - won both, although it was quite an experience going through it!

Since then I have had to go through filling another form for DLA and they reduced my care rate. I wrote back and asked for reconsideration - they overturned the decision in my favour. The cost of all the tribunals I think is causing them to reconsider many before it goes that far.

It is going to be very interesting to see what happens from next year when they cease DLA and we will have to go through the changes and have to apply for PIP! It is a lottery in many cases.

With people on Incapacity Benefit being transferred and assessed for ESA has been causing them a headache and I don't think that all the people that were on IB have been transferred from IB to ESA yet!

it just seems so daft, they had the information i sent for months before reconsidering, they waited til the last moment, whats the point of that?
I know someone who was about to leave the house for her hearing and they rung her up saying we've reconsidered, dont bother going to the appeal! Crazy!

I think is a waste of tax payers money when they could simply review decide what award they intend giving then leave it at that. You have the choice of appeal or not.

Unfortunately, all these bureaucracies are the same. Self serving and interested in making sure its jobs are safe by ensuring more and more work is created to serve itself.
