Hi,
- I bought a weekend bag from an online company in June
- Paid by debit card
- When lifting it with my weekend clothes and wash things in it, the handle ripped the fabric (VERY thin, with a thick leather strap stitched into it - not fit for purpose. It had lining but the handle wasn't stitched to this, just the thin outer layer)
- I didn't use the bag until after 14 days of receiving it
- I first emailed them about 16/17 days after receipt
- The company are saying they will only offer a replacement or credit note as it's after 14 days.
Do I have a right to a refund as the bag was not fit for purpose? I didn't know it was going to break within the 14 days. I had to buy something else as I was travelling on a plane, so now I don't want or need this bag.
Thanks!
Roz

Under SOGA you have the right to a refund, a replacement or a repair. You can request which you'd prefer but ultimately what the retailer offers is up to them. They have offered what they are required to do by law. You cannot force a refund of actual money, but asking them might work.0

The law is ambiuous in that you have 'reasonable' time to reject for a refund - some may consider 14 days outside of this window.
It is changing though, to a fixed 28 days0
