solicitors with vast knowledge of garage's bad parctice
Is there anyone that could help ... i am currently in the process of a small claims action against a car garage.
On Tuesday 6th i called CCMCC to see if the defendant had filed a defence as the 5th august was the deadline. I was told no and therefore could proceed with judgement on him. This morning 10th Aug i received not only his defence but also a counter claim ..:mad::mad::mad:
Not sure where or who to turn to .... funds are virtually nil so i'm wanting to know if there are any , no win no fee people out there and what the commission if winning would be ..

You are unlikely to be awarded solicitors costs so not worth it.
You go to mediation over the telephone then a hearing. Let the judge decide.
Or tell us the case, counter claim and see if anybody can advice0 -

No, mediation is offered as standard before a hearing before a judge. It should ask on the paperwork if you will agree to this, doing so involves both parties agreeing a time where court staff will act as a go between between you both (you don't talk directly to each other) to reach a solution. If no solution can be sought the hearing will go ahead as usual.
My third point about posting the issues here is merely for us to offer opinions and advice which may or may not be of use to you.
Small claims court though doesn't generally offer solicitors fees because it is designed for a layman to be able to use without representation. The idea is you don't need to be legally trained or necessarily even know the law - but a judge will hear your case, hear there case and make a decision (or possible adjourn the case if necessary).0 -
What about the 'defence' deadline issue ?
Whats the point if it can be ignored or has no bearing ?0 -
Even if op did receive judgement by default you (the defendant) can apply to have it struck out and the case go to hearing as it would have anyway.0
