S75 for holiday

I have booked a Disney World hotel directly through Disney (flights separate with Virgin Atlantic).

There are rumours of construction work at this particular Disney hotel that may or may not be happening during my holiday.

I dont really want to change hotel as I have always wanted to stay at this resort. Disney have not confirmed anything regarding construction but from what I am reading on various forums, they tend not to until the last minute.

Basically my question is this: If the construction was happening during my holiday and was significant enough to cause a major disruption, do I have any S75 rights if Disney have not notified me of whats happening before the holiday or if they do not at least offer me a suitable alternative?

    Essentially, if Disney are in breach of contract you have the choice of claiming against Disney or claiming against your CC provider.

    Paying by CC doesn't change the terms of your contract - you don't get better terms (or increased rights to a refund).

    So whether you chase Disney or the CC provider, you will have to explain why you think the contract was breached (or your statutory rights were breached). It's hard to know whether Disney or the CC provider would be an easier target.

    (My guess is that Disney would be the better target. They are much more of a customer service focused organisation, and are keen to preserve their reputation - so they may even make a 'goodwill gesture' to a dissatisfied customer, even when they have no legal obligation to do so.)

    I suspect that should the worst happen and I arrive to find the main lobby is a building site and the main pool is closed for refurb then Disney would offer a suitable alternative if I were to voice my dissatisfaction to them.

    Of course if Disney at least let me know in advance what would be happening whilst I am there then I could arrange with them to move me to a different resort in order to avoid any inconvenience. I just dont want to change resort now as it is more than likely that any disruption would be minimal.

    Construction is unlikely to be a breach of contract and so S75 wouldn't apply. Whilst Disney themselves may consider goodwill payments obviously a credit card company wouldn't just for general poor service etc from a vendor
