Emploee paying employers ni

Hi,
Out of shear desperation my husband has taken a temp on going job with an agency. When he got his first wage slip we noticed that he has paid an Admin fee and employers NI.
Now i know that some agencies do charge admin fee, £18 in this instance, bit sickening knowing that they pocket as much as hubby does, although saying that he was NOT informed they would be taking that.
The main thing is the Employers NI, can he be made to pay the NI that surely they should?, i will probably ask down the tax office, when i manage to get down there when i manage to get the company PAYE ref no for Tax creds, but just wondered if there was anyone who was savvy on this and could advise.

    This sounds like an umbrella company arrangement.

    Employers NI shows on my payslip too but not as a deduction from my salary

    But presumably you are not working through an umbrella company in work arranged by an agency.

    No I'm not, just wondered if it was the same on OPs payslip I.e, not actually a deduction. As some payslips are not clear or easy to understand!

    I think the "Admin fee" gives it away as an umbrella company which is taking its fee which would not cover the cost of the Employers NI.

    The agency may not have made this clear when offering the work.

    I would have expected there would be some "Expenses" shown as a positive figure.

    They have said something about expenses but not very clear
  • After digging about i have found some info, they state food is claimable, yet another sorce says it isnt, they say travel to and from work, when he was self employed, we werent allowed to claim that as he went to the same place every time, and also states that the admin fee is claimable.
    Why the heck was he not told all this in the beginning,thats 3 weeks of expenses he has missed out on, it so pigging annoying, its not like they are paying above everage for the work he is doing, its a bog standard amount.

    Looks like he is working through and umbrella company and within IR35.
