Parking charge notice help

Hi all.
Here goes, I have just received a PCN for overstaying the free allotted time set by the car park. It's a Lidl's in Scotland and the company is Athena. The car park used to allow free parking for 60 minutes for customers so I always make sure I am away before the hour. But the other day I received a letter with a photo of me in the car, albeit not a great one, stating I was parked over the 10 minute allotted time for non-customers but I was under the 60 minute limit for customers. So firstly they are assuming I wasn't a customer, which I was but do not have receipt to prove it. Secondly, I have since been down to read the sign and the small print says the driver must register their car details in store for free parking. I park there quite a bit and never once have I received a PCN before so I can only assume the sign has been changed to look the same with the added small print of having to register car details. And today there is now a massive banner appeared advertising free parking for customers. So to sum up, am I knackered due to this small print and have to pay or can I ignore has seems to be the general advice?
There doesnt seem to be any previous posts with this 10 min for non-customer thing so wanted to find out if anybody else had experience of this

Does the registered keeper live in Scotland?
You are safe to ignore in scotland - PoFA doesn't apply there so there is no registered keeper liability and they don't know who the driver was unless you tell them, so they are stuffed. You will get letters from debt collectors but they are all bark and no bite, so eventually they will fizzle out. Be thankful you live in Scotland! :-)I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -
Can they not link the photo of me in the car to the photo on my driving license? And yes the RK lives in Scotland0

Who? The Parking Company? :rotfl: You're having a laugh. How do you thnk they would ever get access to your driving licence (short of you sending it to them)?
As you are in Scotland the PPC can only pursue the driver, if they don't know who the driver is, how/who can they pursue.
Tell me you're not going to send them your driving licence .......... tell me you're not ......... are you? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Are you serous??? I reckon you have been watching roo many cop shows on TV!
The ticket that you have is issued by a private limited company. The DVLA do sell them your name and address, but definitely not your photo.
In any case, it's all academic because in Scotland/N.Ireland, you can ignore everything with impunity. All that is necessary for the triumph of evil is that good men do nothing. Edmund Burke Irish orator, philosopher, & politician (1729 - 1797).0 -
I am 100% not sending them anything. I just thought if the DVLA gave them name and address it might have included a photo0

Ignore, even if they are foolish enough to do court, they won't be able to prove the car-park owner suffered a loss.0

Let me be blunt regarding the chances of the PPC taking you to court:
There is a greater chance of Hibs winning the Scottish Cup. I am not exaggerating.
Hope that cools your jets!0 -

Hi again. So I have just received the 3rd and final letter to pay within 7 days or they will seek enforcement from County Courts for either bailiffs warrant, attachment of earnings order or third party debt order. Am I still ok to ignore this?0
