    The letter should say from what date he is assessed to pay..........do you have a notification saying you are entitled to X from Y date?

    The first one i can't find but then he told them he earned less, so they did a change of circs on 11/2/2013 and said that amount was payable from 31/12/2012 , i phoned and they said the arrears up til

    That date would be at the higher rate from July and then from 31/12 they would be at the lower rate. They advised it would be about £1700 but was still being calculated.

    Then i received the letter saying no arrears. Does that make sense?

    I think what you've got is a collection schedule for regular maintenance only. Give them a ring on Monday and ask for an arrears figure and what is being done to collect them. I think, from what you've told me, that there are some arrears, the collection schedule is just not adding in an amount for repayment. Let me know if I'm wrong!

    Thanks, it is a clerical case, but was being chased by my MP so was being dealt with in Edinburgh i think, i did get £175 for their failing to sort it but i will phone on Monday and let you know what they say if thats ok?

    Absolutely, I'd like to know if I was right! My heart sinks when I hear it's a clerical case - even staff at the CSA centres struggle to get information on clerical cases.

    Tell me about it! I have a feeling they are trying to say because they opened the case with wrong info from HMRC i received payments which i shouldn't have had, because they shouldn't have opened the case. They very kindly said i would not have to pay back the money they collected from him . Therefore i am not entitled to arrears due on the new case!
  • Well I was right, they are saying because I received payments due to CSA error on the closed case, there are no arrears on the new case as they have to be careful with SOS money !
