Hi I'm looking for advice I recently sent a sar to Am Ex, They duly sent all information held. In 2001 I applied for a Blue credit card and was accepted. In the agreement they sent back it shows down one side all the benefits of the card including payment protection.under my signature there is a very small paragraph which reads
"please enrol me in the American Express payment protection plan. I confirm I am eligible with the terms and conditions shown in the enclosed leaflet. if I make a claim other insurers may be contacted for more information about my claim please tick box".

my questions are.
1. I didn't receive a leaflet at the time or in my sar pack
2. no where in the agreement conditions does it set out terms or mention PPI or the costs involved.
3. I had medical issues which have resulted in time off work so wouldnt be covered
My question is was I missold ?
does any one have any advice for me thanks

Only you can answer whether you were missold, but if you bought by post or online and th eboxes were not pre-ticked, you have less chance of success because you bought it, it wasn't sold to you.
However, you may get lucky with an auto payout.

Thanks for the reply but the fact the terms and costs were not in the agreement constitute misselling ?

You wouldnt expect one with the SAR as it is a document that is not personalised. If you didnt get one at the time then why did you sign to say you did?

it wouldnt do with card PPI.

How do you think it was mis-sold? The documentation points to you choosing to buy it without the involvement of anyone else.

Thanks for the reply, my signature was not against the PPI section but in the credit agreement section, although I doubt this makes any difference

Well, if I told you to throw that amount of money away, would you?
For the price of a stamp, printing some paper and an envelope, what do you think?

Hi thanks again, I have just read a blog that it costs the lender more than £500 in costs if I go to the FSO after rejection. As my will ppi is less they may offer a good will gesture do you know if this is correct ?
