My exes mother is threatening me that payment defaults are going to be on my credit report for something that is in her name and I don't know if that can happen.

Basically I was paying for a sofa on credit for my ex and I, but it was all in her name. the only thing the credit company had from me was my bank details for the payments. The credit agreement is in her name only.

When my ex and I split up he eventually gave me the sofa as I was the one who had paid around £1250 for it so far, but I had to move house and couldn't keep it so I sold it. I was going to use that money to pay the rest of the payments off (apparently there are another 8 payments due at £32 each) but my ex owes me a lot of money. After giving him time and plenty of warnings, all of which were ignored, I cancelled the sofa payments with the view that if he won't pay me back my money, he can pay the rest of the sofa payments to his mother instead.

However, she is now threatening me that because they have my bank details she has spoken to the creditors and they will be putting the defaults on MY records. Can they do this when its not in my name?!?!

She said she was going to tell them I stole the sofa, which is ridiculous seeing as it was her fiancee who delivered it to me.
Can this affect my credit rating just because the money was coming out of my bank account, even though it wasn't in my name? What should I do?! Can I contact the lender and tell them it no longer has anything to do with me?

My ex has left me so out of pocket in so many ways I refuse to just pay up the remaining payments. Not to mention I let him keep the sofa for 5 months after I'd moved out during which time he ruined it and I couldn't even sell it for anywhere near what it was worth.

If the finance is in her name then any default would go on her credit file not yours.

The only way your credit file could (possibly) be affected is if she took you to court saying you owed her a debt or owed her for the sofa and was sucessful in obtaining a CCJ against you.

  • So there is absolutely nothing she can do in terms of making up stories to the creditors that would allow them to register any defaults in my name?
