Hi I was wondering if you guys could give me some advice.
I went CSL to have a sofa on finance in 5th may and set it up, they said delivery lead time is 3 months, it was due to be delivered yesturday, however they phoned me to tell me they had built a manual sofa instead of an electric one and have had to send it back. with this there is now another 3 month lead time.
when i said i would like to cancel they said normaly you cant withdraw and she would have to speak with her manager.
I dont want the sofa in another 3 months. what are my rights?
do i really have to go through with it ?

My personal opinion is that you are being screwed around, you were told 3 months and now you are being told another 3 months, I would demand a refund and go elsewhere. Absolutely ridiculous. This is entirely their error, just demand a cancellation, who would wait six months for a suite? I'd inform them they have breached their agreement to deliver within the time stated (this should be on your sales contract, check), and I would cancel the finance agreement for it, if you have one, before they can trigger the payment. Just say you will refuse delivery. Have you paid a deposit?0

If that was actually ever made. Is it worth calling their bluff and asking them to deliver the manual one with a partial refund?

No deposit paid, payments were meant to start when I recieved sofa, they have asked me weather I would like to loan the manual one until mine is ready, and offered me 10% discount, but I just want to cancel cuz wont get it til nearly Christmas!!!!!!!This is a system account and does not represent a real person. Do you have anything in writing with regards to delivery/completion date?
If not, write them a time is of the essence letter (google it for a template) and send that off to them.
Also point out to them that for a contract to be balanced, it must be legally binding on both parties. That is to say, they cannot bind you to your obligations if they are not meeting their own obligations under contract.You keep using that word.
