Computer part faulty after 2 1/2 years, my stance on a refund?

Hey there,

Basically I bought a motherboard for my last computer 2 1/2 years ago (2 years, 4 months, 12 days to be exact). Now it has developed a fault that means it is unusable and due to time I was forced to build a new computer before I could start the RMA procedure on this part.

for all you 'Techies' it will no longer accept RAM in triple channel mode so I can only use 4/6 DIMM slots else it wont post, it also decided that it had enough and fried one of my GPU's (gtx 680). but I got that replaced............ANYWAY,

the motherboard in question is: Asus Rampage Extreme III
This part comes with a three year warranty. Knowing this I contacted Asus and they basically fobbed me off saying it up to the retailer I bought it from to deal with the RMA so I did, I contacted SCAN and was told that after this amount of time I am not entitled to a refund and all they could do is return it to ASUS for a Repair/Replacement???? surely if a product is under warranty I can ask for my money back if it goes faulty within that time?

So really I am just wanting to know if it is within my rights to get a refund/partial refund on this product and who to ask for it?. I also know for a fact they cant replace it as they no longer make the board any more.

    For the 3 year warranty, what was the wording of it on the box when you bought the mobo ? Did it require any registration ?

    Very unlikely. That really depends on the terms of the warranty.
    They usually say that any liability is limited to a repair or replacement of the product.
    You also need to be sure just who is supplying the warranty... usually the manufacturer.
    You need to read your warranty documentation.

    However, you have statutory rights under the Sale of Goods Act against the seller.
    You will need to prove that the thing was inherently faulty. Having done so, the seller must provide a remedy of repair, refund or replace. If a refund is decided upon, that can be reduced to take account of the use you have had.

    What they are offering is in line with your legal rights. After you have accepted the goods (this is once you have had time to ensure it conforms to contract) then you are basically forced to accept a repair or refund. Any time after 6 months, the retailer can ask you to provide evidence that it is an inherent fault (not wear and tear or user damage).

    The warranty is in addition to these rights and they can stipulate their own terms.

    Ask for a replacement then sell it.

    In answer to your point,no you are not simply entitled to a refund
    best action is to let Scan return it and see where it goes from there

    I know what you are thinking but it was not my PSU, as i am still using that very PSU right now in my new pc and have been for two weeks without issue. Enermax Revolution 1050W (jap capacitors, tier 1 PSU)

    Alright i will return it to SCAN and let them have a look at it. thanks :P
