They are trying to exclude him but it is not that easy because he has very good contact with children.
I think I worded my previous post wrong. I spoke to the solicitor, friend of my friend ect. Didn't mention about reporting children's neglect. She advised me about it not their solicitor. Said that PR is automatically gained when issued residence order but if they split up step father won't have PR anymore.
Yes, but they've got to GET a residence order first. Let's assume your husband represents himself in court for one moment, so you have very low costs: can they, in your opinion afford a protracted legal dispute costing five, ten thousand quid, just to get a residence order that won't materially change anyuthing much other than giving them a feeling of power? I'm going to hazard a guess that for most people the answer is "No".
An application for a residence order is a gamble for them: your husband might, for example, counter apply for SHARED residence, to ensure the children understand both households are equal. On a scale of 1 to 10, how much do you think they want to risk that?!
Think about it: what reasons could they give as to why a residence order is needed? Remember at all times that one of the principles under which judgements are made is that the welfare of the child is paramount: how will their welfare change if a residence order is made to her household?? NOt at all probably, so you could also argue in court that NO order should be made, as it brings no benefits to the child and only serves to marginalise the father...
Don't get in a state and fret about this - stay calm, but also say a resounding NO to signing any residence orders or parental resposibility agreements.
Also, go and get some other legal advice...(I bet it was a woman with kids, right?) She makes it sounds like you've lost before you've even started! Costs are RARE in family court, and you need to seek proper legal advice to see what realistic chance the mother has of pulling off a residence order instead of shared residence or at the very least an order that NO order should be made.
Go get some advice, and empower yourselves. Don't sign away rights to the kids without a murmur.0
