New houses being built opposite me

Hi people,

I wonder if somebody could perhaps advise me. We bought a new home built by George Wimpy back in 2008. When we bought the house we chose our lot due to the fact that it would be overlooked at the front. We were assured at the time that it would never be possible to build opposite as there was a natural fault that ran across the land, hence the higher lot price (Unfortunately nothing in writing).

Low and behold 5 years later we have been advised that Persimmon (Jointly developed the estate with Wimpy) have submitted planning permission for 119 homes opposite us. The entrance road to around 30 of these houses will be directly opposite our house.

Apart from objecting to the planning permission would there be anything I could do to stop this, or perhaps would I have some sort of recourse with Wimpy homes?

    Vague assurances mean nothing!

    On what basis are you planning to object to the PP? Having your house overlooked won't be particularly compelling. They will just throw it in the bin, so save your time and effort.

    What would you object to where planning was concerned? Is the entrance to the new estate in an unsuitable area traffic wise?

    Most developers will build on any land they have, my brother has a barratt house that is in the middle of an industrial estate, originally there was a small lawn next to the show home but they have now built a three property on it.

    If you are not happy looking out on to other houses the only alternative would be to move.

    Unless you have something in writing I would imagine you don't have a leg to stand on.

    There a number of issues that I will object to in regards to the planning permission to name a few are :-

    1. The council have advised that the current roads have the capacity to deal with 400 units but based on the number of new houses this could be 483 which is over capacity.
    2. The natural fault will run directly though 12 gardens and will affect 9 houses.
    3. The traffic survey submitted with the plans is out of date.
    4. The planning permission is for 118 houses whilst the plans show 119 houses.
    5. There are newt, badgers and bats living in the area that has been earmarked for development.

    There are also a number of other issues with the proposed development in regards to the far boundary of the new estate backing directly onto a landfill site, but that is another story.

    You can object, but I doubt you will get far.

    These estates are going up all over the place, even on greenbelt to meet the demand for housing the govt has set out
    Debt free as of 7.20am on 31st December 2012.

    did you or your solictor check the planning permisison for the estate you moved in to? your house could possibly have been part of one phase of a larger development. what they are propoisng now is possibly a third or fourth phase of a much larger development. if its a reserved matters application i'm afraid you have little to object to other than the way it looks as the principle may have already been established through an outline planning permission.

    What do you mean by natural fault?

    I suspect the selling agent at the time just told you what you wanted to hear to get the sale. I bet if you asked for it in writing you wouldn't have got it.

    Buying any build is going to be very high risk that the area around you will be expanded on.

    If you knew the number of objection letters I used to see saying that! (I worked for ten years in a Local Authority Planning Department).
