Advice please

Recently, I contacted a patio door company for a quote. They told us that they could do the work within 6 weeks. We told them that that was too long and that we would look elsewhere. They then told us that they could do it within 2-3 weeks so we went ahead with the quote. After 5 weeks, we were called with an installation date. On the day of the installation, they called to cancel. A week later we called to tell them that they had not kept their side of the agreement and that our order was cancelled.

We have just received an invoice from them for the full amount, in which it states that the dates are a "guide" and that we have "denied access" and therefore the full amount is payable even though the work has not been done. Clearly this is ****ocks, but could use some advice please.

    Had they provided you with an installation date after their cancellation?

    Usually you would send them a letter stating time was of the essence, and if they hadn't completed the work by a set date you would cancel. This essentially covers your back.

    They could, in theory, claim their losses from you (which certainly won't be the entire costs but could include manifacturing costs). Of course if it came to court, the constant delays would provide a defence on your part. What sort of paperwork do you have showing this, or was it all done by phone?

    We did not pay a deposit. After cancellation, no further booking was made, and it was after a week that we told them that we would like to either cancel, or receive the work at a reduced rate. This is when she in her own words "got heavy" and told us that we were in breach of contract and we liable for the full amount. All communication has been via phone or email.

    I would give them the option of cancelling and a full refund, or carrying out the work in full within 7 days less the sum of £X which equates to loss of earnings for the day you had to take off when they cancelled on the day.
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')
