Help! I recently purchased a hardtop for my new double cab, which cost me £1,500. The company who fitted it caused damage to my car and the hard tops windows leak. After no luck with the company I contacted the credit card with photographic evidence and a letter from the dealership who originally sold me the vehicle which stated that the fitting of the hardtop had devalued the car. This was not enough for the card company who requested 'a report from a company that deals with the same type of product'. I have contacted 8 such companies, who all do business with the company I bought the hardtop from so they are not prepared to comment on this basis. It appears there are only a small number of companies that do this work and they all know each other! I feel we are being discriminated against by the credit card company because we've purchased a product from a niche, clicky industry. Can anyone help with any advice?

Generally, the CC company is just jointly liable with the supplier. In the most obvious cases they just voluntarily pay up, but if they refuse you can sue the supplier or the CC company or both.0

Typical CC nonsense. They are jointly liable for this - instead of doing any investigation themselves they just throw up unrealistic demands.
Suggest you write to them saying you will sue them unless they pay up. State that you have done your best to comply with their request even though you feel it it is unreasonable given what you have supplied them.
Remember you entitled to recover whatever it costs to put you back into the position you would be in had the contract been performed properly. This can be in excess of the original purchase price.
After you've issued the claim form, there is still ample time to negotiate. They will probably make you an offer. Ultimately if no deal is done, it will be for a judge to decide whether what you have produced (together with your own witness statement) is enough to prove your loss. Unless the CC can come up with something to rebut your evidence then you should win. It won't be enough for them simply to complain you didn't produce what they asked for.0 -

What can they investigate?
Well I guess they could ask the OP to send them his car and get them to take it to someone to give a unbiased opinion of the work done.
Not so sure the Op would be happy to be without the car for a long time though....
Remember card providers are only experts in their own field. Not in everything that can be purchased on a credit card.
Hence it is only fair that a unbiased expert 3rd party gives a opinion on the product.
I seem to remember a post along the same lines a few months ago about a iffy hardtop that was leaking.
Extreme viewpoint....
Perhaps given joint liability a card provider should be given chance to reject any purchase that someone wants to make using THEIR money.Never ASSUME anything its makes a>>> A55 of U & ME <<<0 -
In which case shouldn't the card provider commission an independent report.
Dales rider, take the last point but surely this should be a function of whether the merchant is accepted by visa, MasterCard, Amex etc., if the trader is dodgy then they shouldn't associate with them.0
