HP Camera - What can i do?

I bought a Hewlett Packard Camera on 13/6/06 that included a 12 month warranty, it went wrong in less than a month and they sent me a new one. Now that has gone wrong (exactly the same fault) and they refuse to do anything. They say that a replacement only carries 3 months warranty. That would make it that i only had 4 months warranty of them in total

Any suggestions please?

They are talking from their behinds - warranty or no warranty, the Sale of Goods Act states that the item has to be fit for purpose and last for a reasonable time. I don't think a month in the case of the original is a 'reasonable' time and for the replacement to last under a year also seems pretty rubbish! Check out the sticky on this board for the exact wording, then hit them with your statutory rights, right in the kisser (metaphorically of course -they probably won't fix your camera if you actually punch them!).

The replacement is brand new yeh? Then you get 12 month warranty on that, ring them up and explain nicely that you want this one returning and to choose a different one as if youve had 2 and had the same fault on both it would seem something is wrong at their end.

Actually I don't think that bit's correct - you get the original 12 months guarantee, but replacements don't restart the guarantee period. So for the OP you should still have 8 months of your original guarantee left, regardless of how many replacements you've had.

The only problem the OP has is that by dealing direct with HP they have got a new camera - not the item supplied by whomever they bought it from. Theoretically this could damage the rights under the SoGA. However my first point of call would be the retailer - especially as the Sale of Goods act doesn't apply to the manufacturer.
  • Thanks for your replies

Well they promised me a new one to be delivered Thursday after endless phone calls, i waited all day , no camera. It finally arrived Friday.

    Good i thought - NO

I went to take some pictures today it took the first 5 ok , i uploaded them and then went to take more....guess what it wont work - exactly the same problem again , after one day!!!!!

Can i demand a refund for the camera now ??? Thats 3 in 12 months , all the same fault

Please don't be offended, but are you 100% sure that it's not operator error causing these failures? It does seem a massive coincidence that the same fault has occured on three different new cameras (if indeed it is exactly the same problem?). I do however, concede that the same fault could happen three times if there is a weakness in the cameras design.
Did the fault materialise on each occasion after uploading pictures to a PC? If so that could be the common denominator? Do HP have a Technical Helpline? If so why not contact them to confirm it really is the camera?
  • Hi

No im not offended at all, its definitely a fault as they have tested the last 2 they had back.....where the lens should go in and out when switched on or off - it stays half way and if you look at it its not aligned , its at an angle. Once this happens, as soon as you turn the camera on - it turns itself off immediately.

It can happen anytime, not just on uploading ..its so annoying

Fair enough. Looks like a bum camera design or a faulty batch then. I've been caught in the past by complaining about something faulty then had to embarrasingly retreat after discovering the fault was my own all the time! Hence my suggestion.
I'm sure and would hope someone with a better knowledge of consumer law/rights will be along to advise about a refund.
