Seller didn't send ebay item and returned paypal payment but....

Hi everyone

I bought a phone about a month ago on ebay for £300. A couple of days later I received an email from seller saying the phone broke and he is returning my payment. He sent £300 to my paypal but he didn't refund my original payment he just made a £300 payment separately.

Is there any way he can reverse his payment and I end up with no phone and no money? Or is it that once he has sent me a paypal payment he can't reverse it?

I'd appreciate any help. Thanks

    In short it depends how he sent it.

    Personally, to be sure, I would lodge a claim for INR (item not received) in Paypal for the original payment.

    You only have 45 days to do this (from date of purchase).

    If you don't, he could chargeback the payment to you up to 180 days after payment was made, or longer if he files as fraud.

    If he is just naive rather than fraudulent he will worry (with due course), so you can refund the reimbursement he made to you.

    OK many thanks, so when I open the case on ebay shall I state the whole situation or just say that I haven't received the item? Is there a chance ebay will refuse to give my money back if I state the whole situation?
  • As theonlywayisup said just file an item not recieved case stating you have not got your item. That's all you need to say.

    Ebay will ask the seller for a tracking number which of course he will not be able to provide as he did not send. Escalate the case when you can and you will be given a refund. You can then send the other money back to him.
