Sister's husband has used her name for business mobile contract

    I agree, ask the solicitor (although if they are a family law expert they may not be able to offer specific advice).

    Given that they are no longer together, I'd be minded to ring the company up and ask about how the contract can be cancelled (without going into any more detail), but definitely don't do this until speaking to the solicitor. She may be placing herself at risk if the phone company asks probing questions - and it will be taped - and may cause her strategic problems in the split-up (all this assumes that the lawyer meeting tomorrow relates to the split-up).

    Yes, it will about divorcing and custody of the children.
    I'm asking on here just to get a little understanding of what's happening, concerning the contracts.
    So you still think that this is fraud?

    When was the contract taken out?

    When did they split up?

    Why did you sister not challenge the contract immediately given that they were about to split up?

    The facts as presented don't sit well... without knowing the full story, how do we know it's fraud?

    She has nothing to do with bills and she has never had a contract for anything, so does not understand about contracts.
    She did not think he would put her in this situation.
    I have a pay as you go mobile, and even I don't understand about contracts, which is why I asked here.
    It now looks like he used her name which is fraud, which I didn't realise myself.
    So to be clear: He cannot set up a contract for mobiles for his business using my sister's name and using her credit rating.
    The phones turned up at their house with my sister's name on them (as I mentioned above).

    On what you have told us, he has made a dishonest and false representation to gain the contract, knowing that his credit standing was too poor to get it in his own name.

    Yes, there may be other facts which we don't know, but on the face of it fraud has occurred. Your later knowledge of it doesn't take away from the initial fraud.

    As well as listening to the professional advice - Do a forum search here for "ex contract my name" to see a goodly number of examples of what can happen.

    You do realise that if she lets this go-on, and her ex defaults on the bills, breaks a phone, wants to get out or has any other kind of problems, she will be held liable for the entire cost of the remainder of the contract. Which for business and two phones could be a pretty substantial sum!
