PPI Rejected...

Hi all,
I have recently had MBNA send me a letter with regards to PPI reclaim. I have just had a reply from them saying my claim has been rejected.
Is there anyway to dispute this? I.e Tribunal, Ombudsman, Small claims court?

Yes, your response from MBNA should have included details about taking the complaint to the FOS if you disagree with their decision - this may have taken the form of an enclosed leaflet. You have 6 months from the date of MBNA's final response letter to take it to the FOS. There is a long queue at the FOS, months if not over a year for a decision. The outcome will depend on whether you have a valid reason for a mis-sale.0

Forget small claims court. This is not a legal issue. There is no tribunal. Just the FOS.
If you disagree with the response then you have a right to go to the FOS. This is explained in your complaint response (although not all complaints have this right). You need to be aware that there is nothing wrong with having PPI. You are making an allegation of wrongdoing about the sale of it. Some complaint reasons are strong. Others are weak. Some are not even valid complaint reasons. You need to look at your complaint reason and decide if their response is fair. You need to look at your reasons and decide what evidence you have to support it. If you feel you have a good case then refer it to the FOS.I am an Independent Financial Adviser (IFA).
