Housing Benefit- renting from parent??

    you have to charge the market rate and be prepared to evict for non payment otherwide the tenancy would be deemed contived, even if it hasnt been until now.

    It doesn't HAVE to be the market rate. In fact, changing the rental charged for benefit purposes may cause more problems.

    agree with this, I suspect the best course would be to leave the rent as it is currently - not increasing or decreasing
    As has been said though it depends on your daughters age and whether she has children
    You may have a property at £100 per week but if she is under 35 with no children at home then they would base all the housing benefit calculations of the shared accommodation rate which could be £50 per week, depending on her income this may mean she would get no help

    what i meant was that the OP cant now decide to lower the rent in order for the daughters benefit entitlement to cover it.
    because that would make it contrived

    I presume as you haven't answered this, that she has no children. This will mean she is entitled to very little in the way of housing benefit, and may still be unable to afford the house on her own,unfortunately.

    Could she not get someone in to share? May be a good thing anyway given the circumstances.

    The rent doesn't need to be the market rate.

    When renting from relatives your council will look at things a bit more closely.

    Don't change things - they will think things are suspicious if the rent suddenly shoots up when she claims Housing Benefit.
    These are my own views and you should seek advice from your local Benefits Department or CAB.
