Parking eye "fines"

Hi , I received a "fine" in December 2012 from parking eye for staying longer than the allotted time on a Range car park , I have ignored all the letters and correspondence that they have sent but today I received a letter from Northampton county court which is a N1CPC claim form , should I be worried ?? Any help would be greatly appreciated

    This is telling you that the parking company has started legal proceedings against you. Parking Eye by any chance?

    DO NOT IGNORE - if you do, the PPC will enter judgement against you and you will get a CCJ.

    Did you pay for purchases using a card? If so, it is not too late to take the pcn into the shop, and ask for the charge to be cancelled (in fact even if you don't have proof of purchase, you can still go in and explain that you are a genuine customer who overstayed because you were spending money in their store! You will need to speak to the manager, and be polite but firm. They do have power to cancel the charge, even at this late stage.

    There are a lot of threads already on here about what to do when the court papers arrive and, I am sorry to have to say, some of the regulars are getting fed up living Groundhog day repeating the same advice to MSE members who can't or won't be bothered to read the advice already on here on the first couple of pages.

    Now if you spend half an hour or so going through the relevant threads, absorb what is already posted and then come back for advice on specific points you are stuck with, then you are likely to get the advice.

    Some regulars are on holiday at present and those who are not are helping lots of people already.

    I'm sorry if this isn't as helpful as you might wish, but please do read through and see what is already on the forum.

    Of course you should respond urgently to the court over a small claim!

    HTH you deal with acknowledging it then sending a defence in time. Not every case goes to a hearing of course. Make your defence a full rebuttal of every point they make and do not let the word 'court' overly worry you please because even if you lose and then pay you won't get a CCJ or anything (only if you ignore it or if you didn't pay if the judgment goes against you).

    PE never used to try court but now they do and are scaring people. Rise above it and defend it, nothing has changed and there are lots of defence points. Look on pepipoo to see how common your situation is (LOADS of threads about PE small claims going back several pages, all being defended!):
