County Parking Enforcement Agency Notice

Received a notice on my car from the above company. They have the make of my car, the reg and the colour and the notice says i am required to pay a penalty charge of £40. However, whomever filled out the notice has failed to put a location or the attendants name. I only noticed the 'parking warning' on my way back to the car and it was so small you would have to leave your car whilst you got out and read it! My family is telling me not to pay but im unsure what to do. Has anybody dealt with County Parking Enforcement Agency (countyparking.co.uk) before? Should i ignore?

    Are you sure it says Penalty charge and not Parking charge? This is surprisingly important.

    Who had reasonable cause to believe that the vehicle was parked without a valid permit in a private parking area controlled by CPEA.
    You are therefore required to pay a penalty charge of £80 within 28 days. A discounted sum of £40 will be accepted in settlement of the charge if it is received within 14 days of issue of this notice.

    What should i do?

    Absolutely nothing - yet.

    If you do get a notice to keeper, come back here, but while waiting, please read this from the BPA web site

    14 Misrepresentation of authority
    14.1 You must give clear information to the public about what parking activities are allowed and what is unauthorised. You must not misrepresent to the public that your parking control and enforcement work is carried out under the statutory powers of the police or any other public authority. You will be breaching the Code if you suggest to the public that you are providing parking enforcement under statutory authority.
    14.2 You must not use terms which imply that parking is being managed, controlled and enforced under statutory authority. This includes using terms such as ‘fine’, ‘penalty’ or ‘penalty charge notice’.


    Spot the deliberate mistake???

    So, you are absolutely clear. If you do get the NTK, we will all be queuing up to write your appeal and POPLA appeal. And, of course, the letter of complaint to the BPA (if they are members, haven't checked).

    But I stress, do nothing yet.

    Report them to the BPA for calling it a penalty.

    Having read their website (which is full of BPA Code of Practice breaches) I would get an appeal in asap (their is method in my madness).

    Appeal on any grounds as it will be rejected but you should get a POPLA code for an appeal to them.

    This will be a breeze at POPLA and will guarantee them grief too.

    You wait for the NtK. They then have all sort of chances to screw that up too.

    Also, if they are reading this, I bet you don't get a NtK either unless they are even more thick than they appear to be from your post.

  • Ok, just spoke to the british parking association, they have told me to appeal as the company who gave me the notice has not filled in the location or the attendants name, also, because they are members of the british parking association and have used the term 'penalty' they are in breach of contract.

    The BPA are on their side!!!!!!! If you do as they say, then the BPA will do nothing.

    I agree. Make a formal complaint in writing.

    Jeez you seem to think the BPA are some sort of national regulator. They are the PPC's umbrella organisation, an old boys' club. Follow the advice already given and WAIT for the Notice to Keeper to arrive in the post, then send a challenge as the keeper, without naming the driver of course.

    Examples above ONLY to be used as a challenge in your words (written in the third person about 'the driver') when you get the first letter. In addition, the BPA should have a written complaint emailed to them (because they can impose sanctions) but do NOT trust them to advise you on what to do!!
