I have some experience of this, it is not illegal for the company to record calls as long as they are only used for things like training when they are kept inside the company. They would not for example be able to sell the calls onto to other companies, broadcast them or use them in court.

The Data Protection Act covers all things recorded personal and non-personal information. I think it was changed in 1998 and came into force in 2000 to take into account info recorded ie CCTV, but this also covers recording of voice (Im involved with CCTV so have a bit of experience with it)

To comply with the act you must inform anyone if you are recording and this must be done before recording takes place to ensure that if you don't want to be recorded you can stop. You must also specify why you are recording and there are various other hoops to jump through like how long recordings are kept and who has access to them.

The recording is a breach of the act but can only be enforced if someone complains which is done via the Data Registrar. You must put your complaint in writing see https://www.dataprotection.gov.uk or tel 01625 545700.

Unfortunately all that will probably happen is that the company will be contacted and asked to comply and register. Only if they resist would it go any further.
