help and advice

On the 7th July me and my other half took our 4 year old son out for tea. We took his Leappad 2 (which was new at christmas) to keep him settled while we were waiting for our food.

To cut a long story short, we ended up leaving the leappad behind. Anyway after 3 weeks of turning the house upside looking for it, we retraced our steps back to the afternoon we went out for tea and on sunday exactly 3 weeks after we lost it, we called the pub.

The girl on the phone, confirmed that it had been handed in, i should say she was quite specific about the leappad as it is bright green, and that they couldnt believe someone would leave it behind. but she couldnt put her hands on it as a different manager was on. She took our number and said someone would call us back the following day.

No one called Monday 29/07, so my partner called yesterday only to be told that they didnt have the leappad and wasnt sure why we were told that they had it. So my partner a little bit upset and frustrated not only at the manager (but also at our stupidity for leaving it.)

But to go from a member of staff being quite clear that it was handed in, to the manager 2 days later saying that they didnt have it.

some of the things the manager said ranged from:

they never handed it in
someone could have claimed it
she only had my word that we had spoke to someone and they had confirmed it was there, but because we didnt the first girls name.

Ive now asked the duty manager to look through the CCTV on the sunday to see if it had been handed in. I also asked to be able to sit in on the CCTV but she said whe didnt know whethere that was allowed.

i personally believe it was handed in, but what has happened with it next is unclear.

I was wondering if there is anything else we could do, we thought about talking to the police, but wasnt sure if they would do anything. We also thought about writing to head office as well.

I would be grateful for any advice. thank you

The post by Amistupid on your other thread is probably the best you are going to get.

    Three weeks have passed.

your probably right, and deep down I know that, i just thought id give it a whirl on here to see if any one had any advice.

although you say three weeks has passed, what would they do with a childrens ipad that is clearly worth a substantial sum of money. Throw it away?! give it to charity?! give it to the police?! or give to a member of staff to take home to their children!?

The restaurant have a duty of care for the item. If they have breached that duty, you can claim the replacement cost from them.

However you will need to prove the breach, so will need to prove it was handed into them, which is going to be difficult if they won't confirm it.
