Did you actually read the OP,s post?0 -
There would be no point forcing the dealer to do a repair because they aren't going to make a good job of it under duress.0

Maybe, maybe not. But there are plenty of reasons for pushing dealers who are (probably) using dodgy tactics to shift otherwise unsellable cars - and making extra profit into the bargain under the guise of being "helpful"!0 -
you should take the refund - there are plenty of other cars out there - take it from someone who has recently been badly scammed no money no car and an RAC check on a replacement that is no good. I am begging for a refund but they won't so it's court. Take your refund and at least your seller is honourable0

Take the money and get something else. The 307 isnt exactly a rare car and if you get all your money back you will probably be able to find a newer car with less miles and no fault on it.
You will kick yourself if there are all sorts of faults, squeaks, rattles, whatever that appear after they have done the repair.
Not that they will do it anyway from the sounds of it as they will probably send it back to the auction than fix it.
As above, at least the dealer is being cooperative about it so dont pass up on the opportunity.0 -
Thanks everyone, you've given some great advice that's really helped me to take a step back and analyse the situation in a way I had started to find difficult after all the messing about. I've been thinking it over and, whilst a big part of me wants to harangue them into keeping their word and make them stick to the straight and narrow, the whole thing has been dragging on for 6 weeks and I've had enough so I'm going to take the refund.0

Wise decision imo. There are no shortage of cars for sale.0

Don't let him deduct anything for six weeks use of the car.0
