Capitol One claim rejected

Wondering if someone could advise on the following.

Whilst going through the bills a year or so ago I notice that my wife had ppi payments on her Capital One credit card I asked why she had this as we had been self-employed for the previous 5 years hence it was of no use. She rang them and cancelled the policy.

Now the card was taken out in 1999 and my wife had no idea how she had applied for the card or purchased the PPI due to the timescale and said she only checked the balance on her statement each month and hence had not noticed the PPI before.

We put in a claim for mis-selling based on the fact that my wife had no idea she had PPI( a bit weak I know but couldn't really go with anything else)) and today have had the expected rejection letter.

Apparently my wife originally did not have PPI when she received the card but agreed to this when she telephoned to activate it. This was on a non-advisory basis and they are confident she was able to make an informed decision.

Looks like this is dead in the water just wondering if anyone had any advice before I file the letter. is there any historical problems with Capital One telephone sales around 1999?

    That is how most Cap One PPI sales are made.

    No historical problems. Indeed, Cap One have a good reputation for complaints handling and the FOS only overturned around 6% of their decision in the last 6 month reported period.
