Cracked TV Delivered

Hi Guys,

We have had a TV delivered at work from currys, it was delivered on the 18th, so just over 2 weeks ago - but was waiting installation by a specialist so wasn't unpacked until Monday, when it was found to be badly cracked.

I have spoken to currys, who are saying that they are unable to replace it as it wasn't reported in time. I've spoken to 2 people one said 1 week, the other 48 hours, either way we were over. It was bought on-line using a credit card, I just wondered if anyone could advise something to get currys to change their minds or any other kind of come back on this?

    Another thing - their e-mail to me states:

    • We will unpack your product and dispose of the packaging for you—we''''ll recycle it if we can.
    • Before we leave, we''''''''''''''''ll make sure you''''''''''''''''re happy with the work we have done.

    This wasn't done, when I pointed this out to them they said that if we wanted that we needed to ask it when the drivers was here, will that help my cause at all?

    Im not sure but their use of extra apostrophes is astounding.

    Part of the Furniture 1,000 Posts Name Dropper
    Send them a formal letter stating that as per your rights under the Sale of Goods Act you wish to reject the TV for a full refund.

    If they still refuse, Letter Before Action and small claims court. It will help your case if you get the installer to write something saying he attended on this date and on unpacking the TV found it to be cracked.

    Currys use their own delivery service, and they do usually do what they say (unless they were specifically requested otherwise)

    How can you be sure your goods inwards/warehouse workers didn't drop it after delivery?

    Doesn't sound like it was a consumer purchase ;)

    It may be a business purchase, but equally OP may just have employed someone to wall mount it properly.

    The TV was put where it was needed by the delivery guys, and left until our installer came - I guess the installer might have dropped it, but I think someone would've seen him!

    They may do, but some parts of the Sale of Goods Act can be avoided by agreement within the contract.
