Developer A is vastly wealthy and wants to buy 20 more flats like mine this year alone. The estate agent have had to do very little work to get this developer to agree to buy my flat, ie make one phone call to him. The estate agent is telling me that if I take the offer of developer B I will be acting immorally, and that he will charge me the full fee any way.
Having carefully read the contract I can see no basis for charging me anything. It seems to be saying that if developer B had been introduced to me through the estate agent THEN I would have pay the estate agent if I gazumped. In my case developer B only found out that I was selling the flat because I told him ( he already owns 2 flats in my block ).
The estate agent is trying to 'guilt-trip' me into staying with the original offer. Happy days.0 -

I would have thought they will try to argue that they introduced a willing and proceedable buyer , and one phone call or not , they did what you asked them to do , sell your property....
You could call their bluff i guess but if you get shafted by Developer B , your in deep wotsit...Never, under any circumstances, take a sleeping pill and a laxative on the same night.0 -
Developer B has said that if I agree to his offer he will immediately put £5,000 into my account which I can keep if he pulls out. He made the offer without even looking around my flat.
If buyer A was someone who wanted to actually live here rather than add my flat to his portfolio I wouldn't be considering buyer B. Actually, buyer A is probably sipping cocktails on his yacht as I type.0 -
