Now, I'm prepared to accept that at face value but who is it a lot of the time that 'introduces' the claimant to these reptiles?
As I see it, they are indeed saving the cost to themselves and possibly increasing the payout to the claimant but they probably actively do the opposite when the boot is on the other foot and their customer is the claimant in order to earn commission from it.
No one says insurers dont want to have their cake and eat it.
That said with Legal Expenses insurance having a circa 85% penetration (or at least it was a few years ago when I last looked) insurers typically are referring under that cover not for commission (they've effectively had the commission up front).
Technically then you'll may find that accident repair centres are the most common to sell details on to ambulance chasers though historically everyones been at it at one point or another.
As to repayment of employers sick pay, as per http://www.claimsassistuk.co.uk/the-process.php this can only be claimed if your contract of employment states you must repay them sickpay thus it becomes your financial loss. If there isnt then your employers losses are considered too distant for the TP to be liable.0 -
Thanks, I wonder how my partner's employer got refunded? Oh well, I would like them to get refunded if at all possible, but will just leave it up to the solicitor to deal with. No harm in asking.
Am trying very hard to leave it up to the professionals and relax a bit. Im not good at relying on other people and I like fixing problems - will have to learn to let other people do their jobs I suppose!
Thanks for the advice :-) first time I've had to deal with this myself and it's a bit overwhelming, especially as im not feeling great.0 -

Absolutely no harm in asking.
At the end of the day claims are handled by people and people can make mistakes. I know back in my claims handling days as a senior technician anything under a grand would automatically authorise itself and anything under a grand required a second senior or above to sign it off. Typically I was signing off 30 or so payments a day (and I had a small team) and the level of checking could never be that thorough as there was a day job to be done as well. You mainly checked amount, payee and any liability split had been applied more than if the head of claim was justified.
Can easily be a case of someone thinking it was reasonable and sending the cheque and either it auto authorising or their manager not properly checking0
