PCN Nightmare :(

Options
Hi guys I'm in a terrible situation, ive received a PCN from parking eye for overstaying, and after getting some advice from a forum i appealed using their online appeal form and sent the following:

"This is my appeal against your PCN #######

please see (link to supermarket) hover mouse over parking sign, note that the website clearly states free parking. If you feel there are more issues please provide a POPLA code."

I know this will be rejected as i was told, but now im thinking should i have written and posted this in the mail instead? and what are the chances of getting away with this as ive passed the 14 day period and really cant afford to pay this, im really worried as im completely in the dark on this.

Also to add to my misfortune my mother has also received a PCN, she paid for all day parking when visiting Cornwall and a lot of motorists were parking on curbs and in the dirt as bays were full so she did the same and displayed an all day ticket. Then had a ticket put in her windshield.

I'm seriously stressing out now as i am currently at university and have an assignment in for the 19th as well as an exam to sit and really do not have the time or patients to deal with all of this as well

Please could someone help me I'm begging you guys :(

You have appealed. Now wait for the refusal and POPLA code. Nothing more to do in the meantime.
  • hi i have similar problems all i know is there's no need to worry and good advice and help will arrive soon.

Not sure if there's possibly something not quite right here. Maybe wrong, but little tangible information and the fact that the OP is 'getting some advice from a forum' (if it's a kosher forum why come to another?) yet seemingly looking for something more.

OP - I think you need to give us more to take this seriously and spend precious time providing bespoke advice.

You seemingly have done some contemporary research to come up with the 'hover mouse' line of appeal, yet you appear not to be aware of more general, and exceedingly more copiously offered advice, on the POPLA process.

    Over to you.

Edit - just spotted this on Pepipoo - not helping my suspicions much!

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Firstly thank you for your time and reply, for the record that is not me on pepipoo and i do admit my post may be abit all over the place as i am quite stressed as i mentioned above with quite alot going on in my live, but i know we all have problem.

Ok so i over stayed at a parking eye car park by half an hour, and have submitted an appeal as i said, basically i would like to know abit more about the popla process, what it involves, how long it would take, the success rate of this method, chances of my appeal being successful and what happens if it isn't successful as in how much would i have to pay?

if you could please shed some light on this i would be extremely grateful as it would put my mind at ease and allow me to get on with other pressing issues.

    Thank you for your time

OK - benefit of the doubt as you've come back.

If PE reject your appeal they should send you a 10-digit POPLA code within 35 days of your appeal to PE.

You then have 28 days to submit your appeal to POPLA - don't submit without referral back to the forum for guidance. Meantime do some research on this and Pepipoo forums - I'll give you some links at the end of this.

POPLA is a bit overwhelmed with appeals and in a backlog situation, so an appeal submitted today is unlikely to be dealt with for a couple of months.

Statistical chances of success at POPLA - overall chance (semi official figures) 60/40 in your favour, go it alone 0%, with assistance from the forum, better than 90%.

If POPLA find in your favour the PPC must cancel the charge - binding on them.

If POPLA find against you, it is NOT binding on you. You can choose to pay up or ignore. If ignore, then it's up to the PPC to decide if/how to further pursue you. If you're going to pay it's more than likely to be the full charge shown on your PCN (no discount).

Now do some research as you're going to have to put in the work to get this monkey off your back. We'll chip in with advice and fine tuning, but the forum isn't about doing it for you.
