Benefits Advice Please

Hi,

I need some advice on where I stand with benefits please, my husband is disabled and currently has a joint claim for us for income related ESA along with his DLA and is in the support group. His brother has been kicked out of his house by his mother and has come to live with us and our 2 children whom I get CTC for. He is 17 and has no income nor benefit claim of any sort, he is due to enrol in college in September. It now falls on us to support him.

Is he entitled to any sort of income both now and come September and how does this affect us? Also, who needs to be informed of this change?

    If he is intending to continue full-time 'non-advanced' education - child benefit may be payable, as may CTC.

    JSA may be payable - it isn't usually - but if he's been kicked out, it may be.
    It may be appropriate for him to claim carers allowance in respect of your husband, if he will be caring for him 35 hours a week.
    This might also entitle him to income support.

    Claiming CA or IS on the grounds of care is complex, and may affect your benefit.

    Thanks very much for replying, I didn't think we could claim CTC and CB for him as he isn't our child, could this still be claimed? We are also not entitled to CA

    you dont have to be the parent... you just have to be his caregiver and have him resident

    His parents would have to give up child benefit for you to claim

    Or he can claim income support once officially estranged.

    As he will be classed as a full time student he couldn't claim carers allowance

    Thanks everyone, his parents dont get CB as he's not in college now. Am I right in thinking that he'll be entitled to the £50+ per week income support from now and through college and this will not affect our benefits?

    Yes and it won't affect your benefits as long as you are not claiming lodging and housing benefits just charging him boarding.

    He should also get help at college, how much depends on college, our local one would give £32 pw plus full travel and £3 daily meal allowance on top.

    Good on you for supporting him, I hope it works out and he sticks at college.

    To restate this - his parents would have to not fraudulently continue their claim.
