help!

My boyfriend's partner left him 5 years ago with two children aged 9 and 13 at the time. Since then they have paid maintenance but only have contact twice a year with the children. He has paid the mortgage, bills and maintenance on the house for the past 5 years and now would like to sell it. How much must he pay his ex partner

    Child maintenance has nothing to do with selling a house and moneys due it's the NRP responsibility to do this by law.

    Is the property still in the name of your partner and his ex?

    Depends on if both are named on the deeds for a start?

    But yes leaving, does not mean surrendering property. So is entitled to half (minus the payments so far) - or unless the percentage was split when house was bought, ie 60 40, 70 30 etc.

    Oh and if they're married too

    A lot depends on whether they were married. Given the ages of the children that's a long marriage (period of cohabitation will be added to actual length of marriage). The rules are totally different if they were never married.

    If they were married is there a divorce and a consent order? If not, get one.

    If not married, are both names on the deeds? What contribution was made by either party financially in terms of deposit, bills, mortgage, etc before the split.

    It's not clear from your post who has the children - 'she left him with the children' could be interpreted as she left with the children or as the opposite, she left them behind with him. This could be important in determining a split.

    The youngest was 9, plus 5 years = 14 years old.

    He might - have to wait another 4 years im afraid, not alegal expert but think his ex wife might have a legal right to the family home until all his children turn 18...

    the op says his wife left him and took the kids. I think he means she left the home and he has been living elsewhere, so this may not really apply.
