CarMoT-Should I complain?

I bought a Volkswagen car last year. When I bought the car the ESC light was on. I was misinformed by the seller that the light would go off if I press the EPS light off button in the car. As it was a safety feature I never tried to switch off the light.

What I didn't notice was that in the last year's MOT under advisory items the ESC light was mentioned.

This year as per the new MOT rules, my car failed its MOT as the ESC light was on. Volkswagen kindly replaced the part for free.

This item 'ESC light warning' should have been introduced in the MOT early last year, but it was delayed and the implementation started only this year. The seller, who is a big chain in car sales, must have been aware of this issue with the car and the change in MOT test.

Now, should I go back to the seller of my car and complain as they must have known that the car would fail MOT this year? As this is a safety feature, should they have sorted out the issue first before selling it to me?

    Who are you going to complain to?

    Your outside the 6 months of the SOGA.

    The fact you did not try to press the button to check the light went off is your fault.
    Also it was replaced for free.

    Do you moan for a living?.

    yes the salesman knew what was going to be in next years MOT.

    MOT rules swap and change all the time as someone finds a flaw in the testing.

    They could have fixed the fault before you bought it, BUT you were happy to buy a faulty car with a warning light happily glowing away.

    Wait til next years MOT. ALL VW's will fail unless you fit them with Skoda or AUDI badges.

  • this is like saying i bought a faulty shirt a year ago it had a slight rip in it, i wear it every saturday and it never got any bigger but this saturday someone tugged on it to see if it would withstand a tugging test and it failed! can i take it back for a full refund or complain to trading standards as this sort of thing should have been spotted and tested before i bought it although i spotted it and the sales rep said it would re stitch itself in the wash!.

    Your missing the bit that, the shirt was repaired for free by the makers.

    The op had the fault repaired for free by VW.

    Now wants to know who to complain too. Who?

    Why do you want to complain? What loss have you suffered (as VW have replaced the part for free, yes it wasn't the original dealer but you are now in the position that you should have been before without any loss).
