The so called 'new' guidelines on what constitute EC's are being talked about on various threads.

IMO the wording:
THE CONTENT OF THIS DOCUMENT DOES NOT REPRESENT A BINDING OPINION ON THE EUROPEAN COMMISSION
...hinges on the use of the word 'ON'.
I think the NEB's have got together (note the date, April 2013) and are making recommendations to the EU as to what should constitute EC's.
They are NOT a new set of guidelines that airlines have to consider. Just proposals of what EC's should be when Regulation EU261/2004 is amended next year. (as per the airlines opinion)

The 'new' guidelines from the CAA, dated April 2013, are merely suggestions from the CAA (funded by the airlines) to the The EU's press release of March 2013, as to what they (the airlines) would like the definitions of EC's to be.
So, no new guidelines or facts of law at this moment in time.0 -

Are you sure? I'm not convinced ... First they are the product of discussions apparently between all NEBs across Europe. And they are pitched as applying now - at least as I read the document on the Commission website.0 -
I think it's a knee jerk to the press release of March 13 as linked above.
Anyhow, it's hardly 'new', - it was published 4 months ago.
At that time I don't think anyone had yet got to court, not even Jeff Halsall.0
